Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Minhaj Kids website and online education services. By creating an account or enrolling your child in any of our classes, you confirm that you have read, understood, and agreed to these Terms in full.

Minhaj is an online education platform owned and operated by GainWells Global Sdn. Bhd., a company registered in Malaysia. By using this website or purchasing any service through Minhaj, you agree to transact with GainWells Global Sdn. Bhd. as the legal service provider.

If you do not agree to these Terms, please do not use our platform.

Minhaj Kids reserves the right to update these Terms at any time. We will notify you of material changes by email or through a notice on our website. Continued use of our services following any update constitutes your acceptance of the revised Terms.

Definitions

Throughout these Terms, the following definitions apply:

• “Minhaj Kids,” “we,” “us,” or “our” refers to GainWells Global Sdn. Bhd., the legal entity that owns and operates the Minhaj platform.
• “You” or “Parent/Guardian” refers to the adult who creates and manages an account on behalf of a child.
• “Student” refers to the child enrolled in our classes.
• “Services” refers to all live online classes, educational content, and platform features we provide.
• “Platform” refers to our website and any associated digital tools used to deliver our services.

Eligibility

Our services are designed for children aged 5 to 14. All accounts must be created and managed by a parent or legal guardian who is at least 18 years of age.

By registering, you confirm that:

• You are the parent or legal guardian of the child you are enrolling.
• You have the legal authority to enter into these Terms on behalf of your household.
• All information you provide during registration is accurate and up to date.

Account Registration

To access our services, you must create an account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately at support@minhaj.kids if you suspect any unauthorised access to your account.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in conduct harmful to other users or our tutors.

Our Services

Minhaj Kids provides live online classes, taught privately one-to-one, in the following subjects:

• Quran (Tajweed and Hifz track)
• Arabic Language
• Islamic Studies (aqeedah, seerah, fiqh basics, akhlaq)

Classes are delivered by qualified, ijaza-holding tutors via video conferencing. Class schedules and curricula are set by Minhaj Kids and are subject to change. We will provide reasonable notice of any significant changes to class structure or scheduling.

We do not guarantee specific academic outcomes. Progress depends on the student's attendance, engagement, and effort.

Free Trial

We offer a free trial class to new families. The free trial is:

• Available once per household.
• Subject to tutor and time-slot availability.
• Not transferable or exchangeable for credit.

Booking a free trial does not constitute enrolment and does not obligate you to purchase a subscription.

Fees and Payment

Subscription Plans

Every plan is private one-to-one teaching with a qualified tutor, in live 30-minute sessions, with session recordings and parent progress updates. Our current plans are:

Prices are listed in US dollars. Local currency equivalents may apply depending on your country of residence. All prices are inclusive of applicable taxes where required by law. The pricing shown on our Fees page at the time of enrollment always takes precedence.

The 10% family discount for two or more children applies to enrolments made through our Fees page. Enrolments made through Apply may use a promotional code instead. A family discount and a promotional code are never combined.

Billing

Subscriptions are billed monthly on the date of initial enrollment. Payment is collected automatically via our third-party payment processor. By enrolling, you authorise us to charge your chosen payment method on a recurring monthly basis.

Failed Payments

If a payment fails, we will notify you by email and attempt to process the charge again within 5 business days. If the payment remains unsuccessful, access to classes may be suspended until the outstanding balance is settled.

Price Changes

We reserve the right to adjust our pricing. We will provide a minimum of 30 days written notice before any price change takes effect. Your continued use of the service after the notice period constitutes acceptance of the new pricing.

Cancellation and Refunds

Cancellation

You may cancel your subscription at any time by contacting us at support@minhaj.kids or through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to classes until that date.

Refunds

We do not offer refunds for partially used billing periods. Refund requests arising from exceptional circumstances (such as extended illness or technical failure on our part) will be assessed on a case-by-case basis at our discretion.

Free Trial Refunds

No payment is taken for the free trial, so no refund applies.

Rescheduling and Missed Classes

Tutor-Initiated Cancellations

If a tutor cancels a class with less than 24 hours notice, we will offer a replacement class at no additional cost or a pro-rated credit to your account.

Parent-Initiated Cancellations

If you need to reschedule a class, please provide at least 24 hours notice via your account dashboard or by contacting support. We will make reasonable efforts to accommodate a replacement session, subject to availability.

Missed classes without notice are not eligible for refunds or replacement sessions.

Code of Conduct

All students and parents or guardians are expected to uphold the values of respect, integrity, and good character that form the foundation of Islamic education.

Students are expected to:

• Attend classes on time and prepared.
• Treat tutors and staff with respect.
• Refrain from disruptive, harmful, or inappropriate behaviour during sessions.
• Not record, screenshot, or redistribute any class content without written permission from Minhaj Kids.

Parents and guardians are expected to:

• Ensure their child has a suitable, quiet space for learning during class time.
• Not record or redistribute live sessions without written permission.
• Communicate concerns or complaints through official channels rather than directly pressuring tutors.

We reserve the right to suspend or terminate enrolment without refund if a student or parent repeatedly violates this code of conduct.

Safeguarding and Child Protection

The safety and wellbeing of every child on our platform is our highest priority.

• All tutors are vetted and hold relevant safeguarding clearances applicable to their country of residence.
• Every class is a private one-to-one session between your child and their tutor. It takes place inside the monitored platform classroom, and tutors have no private contact with a student outside it. Every session is recorded, and a parent or guardian may observe any class their child attends.
• Parents or guardians may observe any class their child attends.
• Any safeguarding concern must be reported to us immediately at safeguarding@minhaj.kids.

We operate in full compliance with child protection legislation applicable across our operating markets, including the UK, USA, Canada, Australia, and Ireland.

Intellectual Property

All content on the Minhaj Kids platform, including but not limited to class materials, curriculum documents, recordings, graphics, and text, is the intellectual property of Minhaj Kids or our licensed content providers.

You are granted a limited, non-exclusive, non-transferable licence to access and use platform content solely for your child's personal educational use. You may not:

• Copy, distribute, or reproduce any platform content without our written consent.
• Record live sessions without explicit prior permission from Minhaj Kids.
• Use any platform content for commercial purposes.

Platform Availability

We aim to provide a reliable and consistent service. However, we do not guarantee uninterrupted access to the platform. Scheduled maintenance, technical issues, or circumstances beyond our control may occasionally affect availability.

In the event of a significant service disruption affecting your enrolled classes, we will offer replacement sessions or account credit as appropriate.

Limitation of Liability

To the fullest extent permitted by applicable law, Minhaj Kids shall not be liable for:

• Any indirect, incidental, or consequential loss arising from your use of our services.
• Loss of data, revenue, or learning outcomes resulting from platform downtime or technical issues.
• The conduct of third-party service providers, including video conferencing platforms or payment processors.

Our total liability to you in respect of any claim arising under these Terms shall not exceed the total fees paid by you in the three months preceding the claim.

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

Governing Law and Disputes

These Terms are governed by the laws of Malaysia. If you are located in another jurisdiction, local consumer protection laws may also apply and will not be overridden by these Terms.

In the event of a dispute, we encourage you to contact us in the first instance at support@minhaj.kids so that we can resolve the matter directly. If a resolution cannot be reached, the dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia, unless local law requires otherwise.

Third-Party Services

Our platform integrates third-party tools for video conferencing and payment processing. Your use of those tools is also subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Minhaj Kids regarding your use of our services and supersede any prior communications or agreements.
